Navigating Bank Secrecy: Regulatory Shifts from Bank of Indonesia Regulation Number 2/19/PBI/2000 of 2000 on Requirements and Procedures for Granting Written Orders or Permits to Disclose Bank Secrecy

Based on Article 1 number 28 of the Law of Republic of Indonesia Number 7 of 1992 on Banking that has been amended several times lastly by the Law of Republic Indonesia Number 4 of 2023 on the Development and Strengthening of the Financial Sector (“Banking Law”), Bank Secrecy is information relating to remarks regarding Depositors and Savings of Depositors.
The Article 40A paragraph (2) of Banking Law mandates that further provisions on Bank Secrecy shall be regulated in a Regulation of the Financial Services Authority as the implementing regulation of Bank Secrecy. Thus, the Financial Services Authority (Otoritas Jasa Keuangan – “OJK”) established the OJK Regulation Number 44 of 2024 on Bank Secrecy (“POJK No. 44/2024”).
Prior to the enactment of Law of Republic Indonesia Number 4 of 2023 on the Development and Strengthening of the Financial Sector (“Law No. 4/2023”) which amended the Banking Law, Bank Secrecy was stipulated under Bank of Indonesia Regulation Number 2/19/PBI/2000 of 2000 on Requirements and Procedures for Granting Written Orders or Permits to Disclose Bank Secrecy (“PBI No. 2/19/PBI/2000”) as the implementing regulation.
